After hearing submissions on penalty, the Adjudicative Committee imposed a fine of $200. |

| Driver B Munro (DOVER TERRACE) admitted a breach of Rule 869(2) and the Whip and Rein Regulations in that he used his whip with more than a wrist flicking motion in the run home. Stewards spoke with the Starter and reviewed the available race films in order to determine whether any individual horse or driver had contributed to the incident. After considering all available evidence, Stewards were unable to attribute responsibility to any one runner or driver. Accordingly, no further action was deemed necessary and the matter was taken no further. | |

| Following the event, Stewards afforded Starter Mr R Donnelly the opportunity to provide an explanation regarding the circumstances surrounding the start, specifically why he had not declared a false start after BIG GEE broke during the score-up, which resulted in TEMPO WARRIOR having to be checked by driver S Ottley and consequently required to start the race out of position. After carefully considering the evidence tendered by Mr Donnelly and reviewing the available race replays, Stewards formed the view that interference to TEMPO WARRIOR had occurred prior to the start which warranted the declaration of a false start. Accordingly, Mr Donnelly was issued with a charge under Starting Regulation 22.2.2, alleging that he failed to declare a false start in circumstances where interference had occurred prior to the start of the race. Mr Donnelly admitted the breach with the Adjudicative Committee imposing a fine of $250. Stewards gave further consideration as to whether, due to a false start not being declared, TEMPO WARRIOR had been denied a fair start. However, as the gelding subsequently finished in 4th placing, the provisions of the Rules did not permit Stewards to declare the runner a late scratching on the grounds that it had been denied a fair start. | |
