Miss Ottley defended a breach of Rule 869(3)(b) alleging she drove carelessly when shifting ground inwards near the 1250m when insufficiently clear of SONG OF SEAS (R May) which had to be restrained and losing its position. After considering the evidence presented by all parties and reviewing the incident from all available camera angles, the Adjudicative Committee was not satisfied that the charge had been established to the required standard and accordingly dismissed the charge.
