Connections did not contest the protest and AND REMEMBER ME was disqualified by the Stewards. A warning was placed on the racing record of the mare. Driver E Johnson reported the mare had been striking the sulky wheels on various occasions.

Stewards questioned Junior Driver E Johnson (AND REMEMBER ME) (assisted by T Mitchell), Drivers T Herlihy (LIL WHIP) and J Abernethy (HENRIK LUNDQVIST) regarding this incident. After viewing the replays and hearing the relative evidence Stewards could not solely attribute blame to any one horse or driver. Notwithstanding this Mr Herlihy and Mr Abernethy were reminded of their obligations given similar circumstances in the future. In considering this matter Stewards took into account that Mr Herlihy had been placed at a disadvantage after losing his safety glasses near the 1600m as well as the outward movement of HENRIK LUNDQVIST contributing to the incident.
