Stewards have completed their review of the incident when TERRIER (R Close) shifted outwards when racing into the final bend with THE DIVA (J Thomas) being forced wider and breaking. After speaking with both drivers it was ascertained that, whilst THE DIVA was hanging in slightly as the horses were approaching the bend, the outwards movement of TERRIER was slow and gradual rather than sudden or abrupt. It was confirmed that, as Mr Close shifted out, he had not fully assessed the speed at which THE DIVA was coming up to him which resulted in THE DIVA being forced wider on the track and breaking. After considering the comments of both drivers it was decided no further action would be taken other than to remind Mr Close of his obligations to those runners around him when shifting ground.
Junior driver K Tomlinson (SWEET LORESS) (assisted by M Williamson) defended a breach of careless driving under Rule 869(3)(b) and after hearing evidence and viewing the films, the JCA dismissed the charge.
