Race 9 - AUCKLAND CO-OP TAXIS 300-3000 MOBILE PACE
The adjourned enquiries have been concluded in relation to the respective driving tactics adopted by Drivers J MacKinnon (WRANGLER) and P Butcher (MAX PHACTOR).

Mr MacKinnon explained that he had been instructed to hold the lead from his pole draw after WRANGLER had disappointed when driven with a trail at its previous start and had performed well when able to lead in the past. He further explained that the early sectionals recorded when pressured by MAX PHACTOR should have been within WRANGLER's ability range given its previous performances but that the gelding had been under pressure near the 700 metres and had disappointed over the final stages.

Trainer R Dunn confirmed the instructions issued to Mr MacKinnon and advised Stewards subsequent to the meeting that the gelding, which had displayed no abnormality following a post race veterinary examination on the night, had been found to have a minor respiratory infection which had been treated.

Mr Butcher explained that he had been surprised that WRANGLER had held the lead after he challenged from the 1500 metres and all but crossed WRANGLER on the first turn before conceding that the lead was not available near the 1200 metres. He further explained that MAX PHACTOR had then commenced to over-race for some distance before he was able to again challenge WRANGLER near the 700 metres when that gelding commenced to weaken.

The respective explanations were noted with both Drivers being reminded of the obligations to ensure their respective drives were given full opportunity in the future.

In addition to this Mr Butcher has been issued and admitted a charge under Rule 303(2) in that he misconducted himself by directing abusive and threatening language to Mr MacKinnon both during and following the running of this event.

After hearing submissions on penalty the JCA imposed a fine of $600.00.
